1.2 These terms & conditions govern your use of the Tesco Opticians site in general, the products that you purchase on the Tesco Opticians site and all services provided in connection with them.
1.3 These terms & conditions do not affect your statutory rights.
2.1 To register on the Tesco Opticians site you must be over eighteen years of age.
2.2 You must ensure that the details provided by you on registration or at any other time are correct and complete.
3.1 When you register to use the Tesco Opticians site you will be asked to create a password. You should keep this password confidential and not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting customer services immediately (see paragraph 24 below for contact details).
3.2 If Vision Express has reason to believe that there is likely to be a breach of security or misuse of the Tesco Opticians site, we may require you to change your password or we may suspend your account in accordance with paragraph 21 below.
4.1 The content of the Tesco Opticians site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the Tesco Opticians site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Tesco Opticians site without written permission from Vision Express.
4.2 No licence is granted to you in these terms & conditions to use any trademark of Vision Express or its affiliated companies.
5.1 You may not use the Tesco Opticians site for any of the purposes set out below (this includes any use by you of the Community sites - see paragraph 6 below for further information about the Community sites):
(a) disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;
(b) transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;
(c) gaining unauthorised access to other computer systems;
(d) interfering with any other person’s use or enjoyment of the Tesco Opticians site;
(e) interfering or disrupting networks or web sites connected to the Tesco Opticians site;
(f) making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner;
(g) transmitting material containing any form of advertising or promotion for goods and services, junk mail, chain letters or “spam”;
(h) impersonating another person;
(i) referring to specific website addresses outside of the Tesco Opticians site; or
5.2 Vision Express reserves the right to refuse to post material on the Tesco Opticians site or to remove material already posted on the Tesco Opticians site. You must not try to re-post material which Vision Express has refused to post on the Tesco Opticians site or has previously removed from the Tesco Opticians site.
5.3 You will be responsible for all losses, costs and expenses reasonably incurred by us, all damages awarded against us by a court and all sums paid by us as a result of any settlement agreed by us arising out or in connection with:
(a) any claim by any third party that the use of the Tesco Opticians site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or is in breach of any applicable law, regulation or code of practice; and
(b) any claim by any third party that the use of the Tesco Opticians site by you infringes that third party’s copyright or other intellectual property rights of whatever nature.
5.4 By submitting material you are granting Vision Express a perpetual, royalty-free, non-exclusive licence to reproduce, modify, translate, make available, distribute and sublicense the material in whole or in part and in any form.
6.1 The Tesco Opticians site may include a number of community sites which may allow users to interact with each other via message boards, and other user forums (the “Community sites”). Full details about your use of the Community sites can be found on the Community sites’ terms and conditions page.
6.2 We advise you not to post or in anyway reveal any of your personal details on the Community sites (for example, your address, telephone number or email).
6.3 Vision Express does not control or moderate the content placed on the Community sites. However, Vision Express reserves the right to refuse to post material, to remove material posted on the Community sites and to contact you in the event that there are concerns about the content you have added to a Community site. Vision Express may review or edit the content of the Community sites. Therefore, if you have concerns about any of the content of the Community sites you should contact us by selecting the “report as inappropriate” button. The relevant content may be removed from the Community sites. If we believe that any material placed on the Community sites by you is unlawful we may contact the relevant authority.
6.4 Vision Express makes no representations as to the validity of any opinion, advice, information or statement displayed on the message boards by third parties. You are solely responsible for the content of your messages posted on the message boards and the views expressed by individuals do not represent the views of Vision Express.
As a convenience to Vision Express customers, the Tesco Opticians site may include links to other websites or material. Vision Express is not responsible for any of these websites or material which is beyond its control.
Part of the Tesco Opticians site may contain advertising and sponsorship. Third party advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Tesco Opticians site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material provided by third parties.
9.1 Although Vision Express aims to offer you the best service possible, Vision Express cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to the customer services team (see paragraph 24 below for contact details) or by email at firstname.lastname@example.org and we will attempt to correct the fault as soon as we reasonably can.
9.2 Your access to the Tesco Opticians site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.
10.1 The terms in this Part B apply to any purchases that you make on the Tesco Opticians site.
10.2 Some purchases made on the Tesco Opticians site will also be governed by specific product terms - please go to PART D of these terms and conditions to see if any of the products you are purchasing have additional specific product terms.
11 DESCRIPTIONS AND PRICES OF PRODUCTS
11.1 We have taken care to describe and show products as accurately as possible. Despite this, products may vary from their descriptions. If there is anything which you do not understand, or if you wish to obtain further information, please contact customer services (see paragraph 24 below for contact details).
11.2 The price offered in respect of a product on the Tesco Opticians site may differ from the price offered at the same time in Tesco Opticians stores. We are under no obligation to honour any in-store price or promotion in the event that it differs from those on the Tesco Opticians site.
11.3 If, by mistake, we have under priced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we despatch the product to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the product at that price. If you decide not to order the product, we will give you a full refund on any amount already paid for that product in accordance with our refund policy in paragraph 16 below.
11.4 All prices are expressed inclusive of any VAT payable unless otherwise stated.
11.5 We do not charge for delivery, whether this is to one of our stores, or to your specified delivery address.
12.1 All products advertised are subject to availability or while stocks last.
12.2 We try to ensure that we always stock the full product range and will let you know if the product is out of stock. If for any reason beyond our reasonable control we are unable to supply a particular product, we will not be liable to you except to ensure that you are refunded for the product, in full.
12.3 In the interests of all our customers, we may place restrictions on bulk buying of some products. If you try to bulk buy products that have bulk buying restrictions we will automatically reduce the number of products you’re trying to buy by adding the maximum amount allowed to your basket rather than the amount requested.
13.1 Your order is an offer to buy from us. We will send you an order acknowledgement email detailing the products you have ordered and an estimated date for delivery or collection in store, as applicable. Please note that this email is not an order confirmation or an acceptance of your order by Vision Express.
13.2 Nothing that we do or say will amount to any acceptance of your offer until we send you an email notifying you that we have despatched a product to you or notifying you when a product will be available to collect in store (as applicable). At this point a contract will be made between us for you to buy and us to sell the products that you have ordered from us. Where products are despatched or made available to collect in store separately, our acceptance of the order in respect of each product takes place when we notify you by email of such despatch or availability to collect in store.
13.3 After the time the contract is made, you cannot amend your order (but please see your right to cancel an order in paragraph 15 below).
13.4 At any point up until the contract is made, we may decline to supply a product to you. If we decline to supply a product to you and you have already paid for it, we will give you a full refund of the amount already paid for that product in accordance with our refund policy in paragraph 16 below.
14.1 Delivery of prescription glasses can only be made to Vision Express stores. Your order will be despatched to the Tesco Opticians store specified upon order and we will email you to let you know when your glasses are ready for collection. You will be required to book a "collection appointment" and have your glasses fitted by a qualified member of staff. Property in the glasses will only pass to you once you have attended this appointment and the qualified member of staff has ensured that the glasses are suitable for you.
14.2 For all other products, delivery will be made to the address specified when you complete the order.
14.3 Please note that we only deliver to addresses within England, Scotland, Wales and Northern Ireland.
14.4 There are no delivery charges. Postage and packing is FREE with Tesco Opticians.
14.5 For all products other than prescription glasses, whilst we make considerable effort to deliver all your products within 7-10 days of your order. Contact lens orders may take up to 15 working days. Sunglasses orders may take up to 10 working days depending on product availability and peak times.Other than this, we shall not be liable if we fail to do so in part or in full due to circumstances beyond our control. We shall contact you to let you know if we are having any problems getting a product to you within that time.
14.6 In the case of prescription glasses, we will use all reasonable endeavours to deliver your glasses to the relevant Vision Express store within 30 days following the date on which you placed the order. Other than this, we shall not be liable if we fail to do so in part or full due to circumstances beyond our control. We will notify you via a contact method you list when placing your order (usually a text to a mobile phone number or an email) when your glasses are ready for collection in-store. If you do not collect them within 8 (eight) weeks of such notification, we will have the right in our discretion to dispose of the glasses. You agree that, in such case, Tesco will be entitled to retain such portion of the cost of the glasses as may, in our reasonable view, cover our reasonable costs and expenses incurred in connection with sourcing, preparing, transporting and storing the glasses. We will refund to you without undue delay any remaining sum in such event by such means as we reasonably decide.
15.1 We hope that you will be happy with your purchase but, if you change your mind, in most cases you may cancel your order (i) in relation to contact lenses in accordance with paragraphs 25.2 and 25.3 below and (ii) for other products up to 8 (eight) working days following the receipt of a product, in each case by calling customer services (see paragraph 24 below for contact details) and returning the product to us. We may in our discretion require that you return the contact lenses to us and charge you a sum, not exceeding the direct cost of recovering the goods, if you choose not to return the product and we agree to arrange for its return, or if you return the product to us at our expense.
15.2 Paragraph 15.1 does not apply to the sale and purchase of prescription glasses.
If your products arrive damaged or they are faulty, you may return them and obtain a refund or replacement product by calling customer services (see paragraph 24 below for contact details).
17.1 If you are entitled to a refund, we will refund you in the method that payment was made.
17.2 Refunds for products purchased under a promotional offer will be based on the terms of the promotional price.
18 PAYMENTS AND CARDS
18.1 Payment for your products will be taken at the time your place your order. If there is a problem taking payment for all or part of your order we will contact you by email. Please note that for all contact lens orders, payment is taken at the point of order, before we have verified your specification with your Optician. In the event that we are unable to verify your specification, your order will be cancelled and you will receive a full refund.
18.2 Your credit/debit card details will be encrypted by the Tesco Opticians site to minimise the possibility of unauthorised access or disclosure.
18.3 When ordering from the Tesco Opticians site we accept orders only from web browsers that permit communication through Secure Socket Lawyer (SSL) technology, for example a 7.0 version or higher of Internet Explorer, version 3.5 or higher of Firefox, Chrome version 10 or higher and Safari version 5 of higher. This means that you cannot inadvertently place an order through an unsecured connection.
19.1 Free gifts and promotional products that are given away in conjunction with a purchase may be despatched to you separately and delivery times may vary.
19.2 If you change your mind and return your product you must also return any free gift or promotional product associated with the promotion and received by you as a result of that order. We may charge you a reasonable amount for the free gift if you do not return it.
19.3 Where indicated on the Tesco Opticians site, we may accept eCoupons, subject to these terms & conditions and any other specific conditions notified to you on the issue of the eCoupons.
We may update these terms & conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Tesco Opticians site. The changes will apply to the use of the Tesco Opticians site after we have given notice. If you do not wish to accept the new terms & conditions you should not continue to use the Tesco Opticians site (including purchasing any products on the Tesco Opticians site). If you continue to use the Tesco Opticians site after the date on which the change comes into effect, your use of the Tesco Opticians site indicates your agreement to be bound by the new terms & conditions.
21.1 We may suspend or close your account immediately at our reasonable discretion or if you breach any of your obligations under these terms & conditions. You will not be able to order products on the Tesco Opticians site if your account is suspended or closed.
21.2 The suspension or closure of your account and your right to use the Tesco Opticians site shall not affect either party’s existing rights or liabilities.
22.1 The Tesco Opticians site is provided by Tesco without any warranties or guarantees. You will bear the risks associated with the use of the internet.
22.2 The Tesco Opticians site provides content from other internet sites or resources and while Vision Express tries to ensure that material included on the Tesco Opticians site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Vision Express will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Tesco Opticians site. If Vision Express is informed of any inaccuracies in the material on the Tesco Opticians site we will attempt to correct the inaccuracies as soon as we reasonably can.
22.3 In particular, we disclaim all liabilities in connection with the following:
(a) incompatibility of the Tesco Opticians site with any of your equipment, software or telecommunications links; and
(b) technical problems including errors or interruptions of the Tesco Opticians site.
22.4 If we are in breach of these terms & conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you order the relevant product or the time you otherwise use the Tesco Opticians site.
22.5 Because we sell products for personal use only our responsibility to you shall not include any business losses such as lost data, lost profits, lost sales or business interruption.
22.6 This paragraph 22 does not limit or affect our responsibility to you if something we do negligently causes death or personal injury.
23.1 You may not transfer any of your rights under these terms & conditions to any other person. We may transfer our rights under these terms & conditions to another business where we reasonably believe your rights will not be affected.
23.2 If you breach these terms & conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these terms & conditions.
23.3 Neither party shall not be responsible for any breach of these terms & conditions caused by circumstances beyond that party’s control.
23.5 These terms & conditions are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in England, Scotland, Wales or Northern Ireland.

25.1 By making an order for contact lenses you are confirming that:
(a) you have a valid, in date contact lens specification from your optician for the contact lenses that you are ordering;
26.1 By making an order for prescription glasses you are confirming that:
(a) you are aged 18 years or over;
(b) you are not registered blind or partially sighted;
(c) if you are under 60 years old, you have a valid current prescription for your glasses which is not over 2 years old;
(d) if you are over 60 years old, you have a valid current prescription for your glasses which is not over 1 year old;
(e) the information you enter into the Tesco Opticians site is true and matches your glasses prescription as provided by your optician;
(f) you have written proof of your PD* measurement from your Optician and acknowledge that the measurement entered is correct and valid,
*if you are unsure about obtaining your PD we recommend that you book a FREE appointment in one of our stores, where our staff will happily measure this for you.
(g) you know of no reason why the glasses which you are ordering are not suitable for your requirements;
(h) you will provide a copy of your original prescription when collecting your glasses, contact details of your optician and any other details reasonably requested which confirms that you are eligible to purchase the glasses you have ordered. You consent to us contacting your optician to verify your glasses prescription and any other necessary information and you acknowledge that if the verified details do not match those provided by you, we will be unable to complete the sale of the products until you have a further eye test with an optician;
(i) you will comply with all instructions for use from your optician and stated on the product or any inserted leaflet; and
(j) your order made via the Tesco Optician site represents a request for prescription glasses by you and the prescription glasses are intended for use by you and no other person.
26.2 Brink Sun prescription sunglasses are priced at £40
(a) Subject to availability and with a valid prescription.
(b) Includes standard single vision 1.5 index lenses with tint and ultra violet coatings. Extra lens options are not included but can be added for the charges shown in our '3 easy steps to your perfect glasses' leaflet.
27.1 By booking an appointment via TescoOpticians.com you are confirming that:
(a) you are able to attend, in person, at the chosen store,at the date and time selected;
(b) the information you enter into the Tesco Opticians site is true;
(c ) you are aged 18 years or over;
(d) you consent to us contacting you with necessary information pertaining to the appointment booked;
(e) that you accept any payments that will incur in-store (sight tests are free of charge – excludes NHS customers; contact lens initial appointments will incur a £15 charge). The cost of a contact lens aftercare is free within the first 12 month period, however it is chargeable at a cost of £15 thereafter.
27.2 You have the right to cancel your appointment at any time.
(a) To cancel your appointment up to 24 hours prior to the appointment time, login to TescoOpticians.com and visit the ‘My Account’ section of the website. From here, browse to ‘Appointment details’ and click 'cancel' on your appointment.
(b) To cancel an appointment that is within the next 24 hours please contact us on 0345 601 3479 to cancel or rearrange for a more convenient time. You can also contact us via the Live Chat facility on our website, TescoOpticians.com. Our Live Chat operators will be able to help you rearrange your appointment at any time prior to the appointment time. Call centre opening hours are Monday-Friday 9am-6pm, Saturday 9am-5pm, Sunday 10am-4pm. Our Live Chat facility is available Monday-Friday 9am -5pm.
28.1 BOGOF applies only to prescription glasses frames worth £65 or more.
(a) Under the terms of Tesco Opticians BOGOF offer only the cheapest pair of glasses will be given free. Extra glasses supplied under the BOGOF offer must be of equal or lower value and will be made to the same prescription to the pair initially purchased.
(b) BOGOF offer is subject to availability. In the event that a second pair cannot be provided, an alternative of equal value will be supplied in accordance with the wishes of the customer.
28.3 BOGOF offer applies to standard 1.5 index single-vision lenses only. Extra lens options will be charged at the normal rate.
28.4 BOGOF offer cannot be used in conjunction with any other Tesco Opticians offer.
28.5 BOGOF offer excludes all sunglasses and Gucci and Dior prescription glasses.
The Tesco Opticians site is owned by Vision Express (UK) Limited, trading under various names including Tesco Opticians, a company registered in England whose registered office is at Vision Express (UK) Limited, Ruddington Fields Business Park, Mere Way, Ruddington, Nottingham, NG11 6NZ, with Company Registration No. 2189907
31.1 Tesco Opticians have partnered with the online review community Trustpilot to collect reviews from customers. If you have agreed to receive marketing from Tesco Opticians you will receive an email invitation to review any product/s or service/s that you purchase from us.31.2 If you no longer wish to receive these emails then you can click ‘unsubscribe’ in the footer of the emails. Please note that this will unsubscribe you from all Trustpilot invitations, not just those from Tesco Opticians.
31.3 By leaving a review on our Trust Pilot page you give consent to Tesco Opticians to use this feedback in training and/or marketing materials including posts on Tesco Opticians social media profiles.
